Terms of service

The agreement between a business running a loyalty programme and the company behind it. Not an agreement with that business's customers.

Who these terms are for

These terms are the agreement between Custback and a business using it to run a loyalty program. They are not an agreement with that business's customers: a customer collecting stamps deals with the shop that issued their card, and what we do with their information is described in our privacy policy.

Using the service means accepting these terms. If you are accepting them for a company, you are confirming you may bind it.

What we provide

Software for issuing digital loyalty cards, recording stamps, and delivering those cards to a customer's phone wallet. We keep an auditable record of every stamp, reward and correction so a disputed transaction has an answer.

Delivery to a customer's wallet depends on that wallet provider — currently Google. We control when they are told a card changed; we do not control when the phone shows it, and we cannot guarantee a provider will keep offering the service.

What the program is worth

The rewards belong to you, not to us. You set what a card is worth, how many stamps it takes, and the conditions attached. You honour the rewards your customers earn. Custback records them; it does not fund them.

If you change or end your program, customers holding cards may already have earned rewards under the previous terms. Settling that fairly is your responsibility, and in many places it is also a legal one.

Your responsibilities

  • Keep your staff accounts secure, and remove people who leave.
  • Only add customers who agreed to join, and only collect contact details you have a reason to hold.
  • Do not use the service to send unsolicited marketing.
  • Everything staff do under your account is attributed to your business, including mistakes.

Customer information

The information your customers give you stays yours. We store and process it to run your program and for nothing else — we do not sell it, and we do not use it to advertise. One business can never read another's customers.

You remain responsible for handling that information lawfully, including responding when a customer asks to see or delete it. Write to support@custback.com and we will help.

Availability

We aim to keep the service running and will tell you when we know something is wrong. We do not promise uninterrupted availability, and during the pilot the service may change or pause at short notice.

A stamp that has been recorded is not lost if the wallet update fails: the record is the source of truth, and the card catches up.

Ending it

You can stop at any time and ask for your data to be exported or deleted. We may suspend an account that is being used to break these terms or the law, and will say why.

Cards already in customers' wallets stop being updated when an account ends. They do not disappear from their phones, so tell your customers before you close.

Liability

Nothing here limits rights you have under the New Zealand Consumer Guarantees Act or other law that cannot be contracted out of.

Beyond that, Custback is not liable for indirect or consequential loss, and our total liability is limited to the fees you paid us in the twelve months before the claim.

Changes and law

If we change these terms we will update the date above and tell account holders. These terms are governed by New Zealand law.
